Below are the penalties and frequently questions of foreigners about an overstay in Vietnam:

Can you leave the country with an expired Vietnam visa?

According to the Immigration Departure entry and exit law, foreigners need to submit a valid passport and visa in order to leave the country. In some cases, foreigners are still allowed to leave the country when their visa be expired from 1 – 4 days and accept to pay the fines at the border checkpoint. However, this way may affect your visa application when you want to come back to Vietnam.

Visa overstay fine

To be able to continue extending a Vietnam visa or to exit the country with the expired visa, a foreigner needs to pay a penalty fee when:

  1. Overdue visa from 5 – 10 days: 1,250,000 VND
  2. Overdue from less than 11 – 30 days: less than 4,000,000 VND
  3. Overdue from 1->3 months: 10,000,000 VND
  4. Overdue over 1 year: <16,000,000 VND

Besides the overstay fine, foreigners may be deported and put on black list of the Vietnam Immigration Department.

How to extend the expired visa?

Foreigners who want to continue to extend the overstayed visa need to prepare:

  • Notarized of the business license from the sponsor organization (if any)
  • Original passport
  • Temporary residence declaration
  • Other documents corresponding to each type of visa: Work permit for visa type LD, investment/capital contribution certificate for visa DT, proof of family relationship for TT/VR visa…
  • Complete the visa application form – form NA5.

How much does a Vietnam exit visa cost?
